PROPOSED VENTURA SETTLEMENT DOCUMENT FINALIZED
COURT APPROVAL TO BE SOUGHT MAY 31, 2005
A proposed settlement agreement covering retroactive implementation of the Ventura decision has been approved by counsel for all parties and is being circulated for signatures. The court has approved a notice to be provided to all class members and has scheduled a hearing for May 31, 2005 to decide whether or not to approve the proposed settlement. Please refer to the Document entitled “NOTICE OF: 1) PROPOSED JUDGMENT IMPLEMENTATION SETTLEMENT DETERMINING AMOUNTS OF BENEFITS, CONTRIBUTIONS, AND ATTORNEYS’ FEES TO BE PAID UNDER FINAL JUDGMENT AND WRIT OF MANDATE; 2) HEARING TO CONSIDER FAIRNESS OF PROPOSED SETTLEMENT ON MAY 31, 2005; AND 3) WAIVER OF OBJECTIONS TO PROPOSED SETTLEMENT IF WRITTEN OBJECTIONS NOT FILED ON OR BEFORE MAY 20, 2005.” (The “Class Notice”)
