LACERA’S
PRIVACY PROGRAM
LACERA's mission is to produce, protect, and provide
the promised benefits. An important aspect of this mission is protecting the
privacy of our members and their beneficiaries. Accordingly, LACERA does
not sell or trade members' personal information; nor does LACERA disclose
it to anyone other than those who need it to provide member services or
those who are legally entitled to it. LACERA's privacy practices are impacted
primarily by two key laws, the 1937 Act and the HIPAA Act of 1996.
1937
Act
In the 1937 Act, California Government Code 31532 precludes disclosure
of LACERA's member records and sworn statements unless proper authorization
is provided.
HIPAA
The Health Insurance Portability and Accountability Act of 1996 (HIPAA)
protects the privacy and security of your individually identifiable personal health information (PHI), and imposes certain administrative requirements.

Beyond these legal requirements, LACERA continuously reviews legislation
and privacy practices to improve LACERA's efforts to ensure the
privacy of our members. To protect the privacy of our member's personal
information, LACERA has adopted a Privacy Program, which consists
of the following:

He may be reached at 626-685-4620. All inquiries regarding LACERA’s
privacy policy and HIPAA privacy rule compliance should be directed
to the Privacy Officer.
You may obtain
records from LACERA either through written authorizations from the
individual whose records you are seeking or through a subpoena.

Training for LACERA Staff and Board Members
LACERA provides training for its board members and staff to enable
them to protect the privacy of its members' personal information.
LACERA's privacy officer is responsible for designing and updating
the privacy training to ensure that LACERA provides current information
and effective tools to its staff and board members.

Q. What does the term "unauthorized use" or
"unauthorized access" mean?
A.
In LACERA's Privacy Policy, the term "unauthorized use" is used
interchangeably with "unauthorized access." These terms refer
to any access, acquisition, use, or distribution of confidential information
(either personal information, protected health information, or LACERA's
proprietary information) in violation of LACERA's business and privacy
policies, or applicable laws.
